  • Why do you need your explicit consent to use cookies?

     

    The AEPD Guide of July 2023, with the contribution of information and criteria from the European Data Protection Board (EDPB), the GDPR-EU-2016/679, articles 5, 6, 7 and 13, and the LOPDGDD-3/2018, article, 6, must be interpreted as meaning that consent will only be valid if it is explicit.

  • Consent of the minor

     GDPR-EU-2016/679, in article 8, sets out conditions applicable to the consent of the child in relation to information society services.

    1. Where Article 6(1)(a) applies in relation to the direct offer of information society services to children, the processing of a child's personal data shall be considered lawful when the child is at least 16 years of age. If the child is under 16 years of age, such processing shall only be considered lawful if the consent was given or authorised by the holder of parental responsibility or guardianship over the child, and only to the extent that it was given or authorised.

    2. The controller shall make reasonable efforts to verify in such cases that consent was given or authorised by the holder of parental authority or guardianship over the child, taking into account the available technology.

     The interested party may exercise the rights of access, portability, limitation, opposition, rectification and deletion of the data and file a complaint with the relevant Supervisory Authority. 

  • What are cookies?

    Cookies are small data files that are received on the terminal from the website visited and are used to record certain interactions of navigation on a website, storing data that can be updated and retrieved.

    These files are stored on the user's device and contain anonymous data that is not harmful to their computer. They are used to remember the user's preferences, such as the selected language, access data or personalization of the website or App.

    • Analysis or measurement cookies: These cookies allow the person responsible for them to monitor and analyse the behaviour of users of the websites or Apps to which they are linked, including the quantification of the impacts of advertisements. The information collected through this type of cookie is used to measure the activity of the websites, application or platform, in order to introduce improvements based on the analysis of the usage data made by users of the service.

    • Advertising/advertising cookies: These are those that, processed by the App administrator or by third parties, allow us to analyse your browsing habits on the Internet so that we can show you advertising related to your browsing profile. Advertising cookies allow the management of advertising spaces based on specific criteria.

    They are those that store information on user behavior obtained through the continuous observation of their browsing habits, which allows the development of a specific profile to show advertising based on it.

    Type of cookies according to the period of time they will remain active:

    • Session cookies: These are those designed to collect and store data while the user accesses a website/App. They are usually used to store information that is only of interest to be kept for the provision of the service requested by the user on a single occasion (for example, a list of products purchased) and disappear at the end of the session.

    • Persistent cookies: These are those in which the data is still stored on the terminal and can be accessed and processed for a period defined by the person responsible for the cookie, which can range from a few minutes to several years. In this regard, it must be specifically assessed whether the use of persistent cookies is necessary, since the risks to privacy could be reduced by the use of session cookies. In any case, when persistent cookies are installed, it is recommended to reduce their temporal duration to the minimum necessary, taking into account the purpose of their use.

    There are two legal obligations imposed by the regulations, the obligation of transparency and the obligation to obtain the explicit consent of the user of the website.

    In accordance with the nature of your business activity, the business model you develop and the scope of your responsibility, it is recommended to carry out a review of the cookies that are used, either internally or with the advice of specialized entities.

    The purpose of this review will be to identify the cookies that are being used, analysing whether they are first-party or third-party cookies, session or persistent, and specifying their function in order to decide whether or not they are within the scope of application of article 22.2. Taking into account the possible changes that may occur in the management and use of cookies, it is advisable to carry out this review periodically in order to update the information available on these cookies. In any case, it is advisable to remember that the solutions implemented to comply with the obligations of art. 22.2 of the LSSI must be technologically neutral and that, therefore, they must be solutions that most browsers recognise.

    It is advisable that the information displayed through which you manage cookies (including how to revoke consent and delete cookies) is available to you in an accessible and permanent way at all times through the website, application or online service in question.

    For these purposes, and without prejudice to other solutions that may be adopted, this requirement will be considered to be met when the cookie management system (configuration panel or a CMP, which allows the owners of the websites or App to obtain, manage and disseminate  consumer consent) and is integrated into the cookie policy itself or when a link is included in this policy that leads directly to the management system or configuration panel.

    AEPD Guide, 3.2.10. Possibility of refusing access to the service in the event of rejection of cookies:

    There may be certain cases in which the non-acceptance of the use of cookies prevents access to the website or the total or partial use of the service, provided that the user is adequately informed about this and an alternative, not necessarily free of charge, is offered to access the service without the need to accept the use of cookies.

    These cookies must comply with the GDPR-EU-2016/679, the LOPDGDD-3/2018, the regulations of the LSSI-CE-34/2002, of update, 23/01/2025, and the GUIDE on the use of cookies of May 2024, of the AEPD with criteria of the EDPB (European Data Protection Board), and by the LSSI-34/2002, Article 22, which requires the annual review and updating of cookies on websites/apps.
